본 연구는「지방교육자치에관한법률」의 개정과정을 통해서 제도가 어떻게 변화되어 왔는지 주 요내용을 정리하고, 그 과정에서 등장하는 관련 쟁점들을 시기별로 탐색․종합하여, 쟁점 변화의 동향을 확인하였다. 또한 이를 통해 지방교육 자치제가 나아가야 할 발전방향에 대한 시사점을 찾 고자 하였다. 지방교육 자치제도의 시기는 이중간선 및 교황선출식 선거기, 선거인단 선거 전기, 선거인단 선거 후기, 직선제 선거기 등 4단계로 구분하였다. 관련 쟁점들을 시기별로 분석한 결과, 두 가지 측면에서 다음과 같은 사실을 발견하였다. 먼저, 지방교육자치제의 운영과 관련된 사안이다. ① 지방교육 자치제에 대한 작금(昨今)의 개선이 주로 법체계의 미비점이나 제도의 부분적인 보완이 주류를 이루고, 제도의 근본적 문제에 대한 접근이 나 개혁적 차원에서의 관련법 개정은 이루어지지 않고 있다. ② 지방교육자치는 어떤 이념을 구현 하기 위해서 개선되었다기보다는 시기마다 직면한 상황에 대한 합리적인 해결책을 구안하는 과정 에서 변화되고 발전되어 가고 있었다. 다음으로, 연구와 관련된 사안이다. ① 분석된 연구들 간에 제안된 관련 쟁점의 내용들과 그 쟁점을 뒷받침하는 논거들이 유사(동일)하게 반복되었다. ② 직선 제 시기에는 이전 시기에 비해 지방교육 자치제도의 전반적인 쟁점을 분석하는 연구들이 많이 감 소하였다.
The purpose of this study is to summarize the main point of how local educational autonomy has been changed through the revision process of Local Educational Autonomy Act. It also attempts to confirm a certain trend of issues, discussed in individual works on the revision process, by exploring and synthesizing them chronologically. It divides four periods. The analysis of the change of such issues provides several discoveries from two aspects. The first is the one which is related to the operation of local education autonomy. ① The recent revision of local education autonomy mainly focuses on partial supplementation of loopholes in the system and law, not on fundamental approach to the problem or reformative revision of the law. ② Local education autonomy, in which the improvement is seemingly driven by the purpose of realizing a certain ideology, has been improving in the process of seeking a reasonable solution for situations confronted in each time. The next is the one that is concerned with the studies. ① The details of and the grounds for such issues are similarly repeated in each analyzed study. ② In the period by direct election system, compared to the other periods, there is a huge decrease of the studies analyzing overall issues of local education autonomy system.
