The aim of this study was to analyze the current state and effects of the regulations on the
organization, implementation and assessment of the school-based curriculum based on the Special
Law for Promotion on Normalization of Public Education and Regulation of Preceding Education. For
this purpose, this study conducted survey targeting principle/vice principle, teachers and school
inspector in the elementary school and middle school. The results indicated that most respondents
recognized that the accountability on organization, implementation and assessment of the
school-based curriculum has been increased after the application of that law, however they did not
recognize that the autonomy has not been infringed. According to these results, this study suggested
that this law make up for the limit of the bureaucratic accountability as a rational accountability
based on the theories of Kogan(1985) and Darling-Hammond& Ascher(1991). To maximize this
merit, the contents of the regulations has to be clear and the ways of the monitoring has to be
modified related to the Elementary and Secondary Education Act
