The Convention on the rights of Persons with Disabilities was signed by
Korea on 9 January 2009. The convention provides that States, which ratify
it, should enact laws and other measures to improve disability rights. With
this point of view, this paper placed independent living as analytic center
that examined the problem of The Welfare Act for Disabled. Findings show
that we have to take complementary measures for some articles about
independent living on the The Welfare Act for Disabled. Second, we need
more accurate legal definition about independent living and state's
responsibilities for it. Third, we give special attention to articles about
social integration on the basis of the principles of equality and
non-discrimination so that prevent inconsistent ideas. Finally, it is need
that we have to reform the The Welfare Act for Disabled for the support
of independent living and community interaction. It is clear that, unless the
legislative structure is amended to include an entitlement to independent
living on the basis of the Convention, disabled people will go on to be
denied their full human rights.
