본 연구는 국가예산을 이용하는 중앙공공기관이나 지방공기업 등 공공기관이 조달계약 체결 시 창 업기업이나 중소기업에 영향을 미치는 정부의 조달관련 법제도를 분석하고, 2015년도 공공기관에서 직접 발주한 조달사업을 전수조사하고, 창업 및 중소기업을 대상으로 공공조달 진입시의 애로사항을 조사하고 분석하여 공공조달 제도의 개선방안을 제시 하였다. 정부조달은 1995년 국가계약법 제정 이후, 국가 조달물자의 효율적인 관리와 중․소상공인의 판로지원 수단으로 활용되어 왔다. 정부의 조달계약 규모는 2015년 기준 119조원 규모이며, 이중 85조원을 중소기업이 차지, 중․소상공인의 정 부조달 의존도가 상당하다는 것으로 조사 되었다. 정부조달 제도는 30만 조달 기업에게 제품․용역 등에 대한 판로를 확보하는 방안으로 필수적이나, 무리한 입찰제한, 불공정 절차․행태 등이 을의 입 장인 창업․중소기업에게 숨은 규제․징입장벽으로 작용되고 있다. 일부 공긱업의 ‘조달입찰 실적제 한’은 기술력 있는 창업․중소기업에게 조달시장 참여기회 조차 박탈하고 있으며, ‘최저가 입찰’ 등 과도한 경쟁을 부추기는 제도는 업체의 출혈 경쟁을 유도해 그 피해는 기업과 소비자에게 전가되는 상황이다. 본 연구는 정부조달의 불합리한 규제를 근원적으로 혁신하여 중․소상공인에 대한 판로지 원 등 성장환경을 조성하는 방안으로 공공조달 제도 개혁방안에 관한 대안을 제시하였다.
The purpose of this research is to analyze the procurement related legal system affecting startup enterprises or small and medium-sized enterprises at the conclusion of the procurement contract by central public institutions or local public corporations using national budgets, This study examines the difficulties in entering the public procurement for entrepreneurship and SMEs and suggests ways to improve the public procurement system. Since the enactment of the National Contract Law in 1995, government procurement has been utilized as an efficient management of procurement of national procurement and as means of support for small and medium-sized businesses. The size of the government procurement contract is 119 trillion won as of 2015, of which 85 trillion won is owned by small and medium enterprises, and the dependence of small and medium-sized businesses on government procurement is significant. The government procurement system is necessary to secure a market for products and services to 300,000 procurement companies, but excessive bidding restrictions and unfair procedures and behaviors are acting as barriers to entry and small and medium enterprises . Some of the public companies '' Procurement Bidding Performance Limits '' are also depriving technological entrepreneurs and SMEs of opportunities to participate in the procurement market. The system that induces excessive competition such as 'Lowest Price Bidding' It is a situation that is transferred to the consumer. This study suggests alternatives to reform the public procurement system as a way to promote the growth environment such as market support for small and medium - sized businesses by fundamentally innovating the unreasonable regulation of government procurement.
