본 연구는 국민기초생활 보장법상에 나타난 신자유주의적 경향을 분석하여 국가가 빈곤에 대하여 책임을 지고, 빈곤한 자들은 권리로서 국가로부터 최저생활을 보장받게 되는 본래의 법이념에 부합할 수 있도록 재정립을 위한 것이다. 이를 위하여 연구문제로는 첫째, 공공부조로서 국민기초생활 보장법의 근본이념은 무엇인가? 둘째, 신자유주의 특성은 무엇이고 복지영역에 어떠한 영향을 주고 있는가? 셋째, 국민기초생활 보장법에 신자유주의적 요소는 어떠한 경향으로 나타나는가?로 설정하였고, 그에 대한 해답을 찾기 위해 관련문헌자료와 법률 등을 활용하여 법해석학적 연구방법을 사용하였다. 연구결과로는 첫째, 공공부조로서 국민기초생활 보장법의 근본이념은 헌법에 보장된 인간다운 생활을 할 권리를 구체적으로 보장하기 위한 법이었다. 둘째, 신자유주의 특성이 복지영역에 미친 영향으로는 국가의 복지에 대한 권한을 축소하고 오히려 개인의 책임을 강조하는 방식으로 쇠퇴하고 있었다. 셋째, 국민기초생활 보장법에 나타난 신자유주의적 경향을 분석한 결과, 다원주의와 민영화적 요소, 효율성 요소, 국가부담 최소화 요소, 노동원칙 강화 요소, 수급권 제한 요소가 나타났다. 넷째, 법 본래의 이념에 부합한 재정립을 위해서는 빈곤한 자들의 권리를 침해하는 배제에서 그들의 권리를 확보하는 포용으로의 재정립이 필요했다.
The purpose of this study is to analyze the neo-liberal trends in National Basic Livelihood Security Act and to reestablish that Act. The research questions of this study are as follows : 1) What is the fundamental ideology of National Basic Livelihood Security Act as public assistance? 2) What is the characteristics of neo-liberalism and how does it impact on the boundary of welfare? 3) What is the trends of neo-liberalism in National Basic Livelihood Security Act? In attempt to answer those questions, law-explanation method based on review of literatures and laws was used. The research results were arranged as follows: Firstly, the fundamental ideology of National Basic Livelihood Security Act as public assistance is a law to secure the right to life. Secondly, the impacts on the boundary of welfare by the characteristics of neo-liberalism is to reduce the responsibility of state in welfare and to emphasize on the personal responsibility. Thirdly, the result of analyzing the trends of neo-liberalism in National Basic Livelihood Security Act shows the elements of pluralism and privatization, efficiency, reducing burden of state, reinforce principles of labor, and limitation of beneficial right. Fourthly, the National Basic Livelihood Security Act should be reestablished not exclusion of poor people but inclusion of their rights to correspond with the original ideology of that Act.
