What is required to maintain and develop the community? Marsilius of Padua, the representative figure of political philosophy in the 14th century considers peace as the indispensable factor for maintaining the community. Unlike Aquinas or Dante, Marsilius, living in Italian cities involved in the conflict between emperor and pope emphasizes the superiority of civil authority over ecclesiastical authority. Furthermore, he holds that the peace in this world would not be brought up by God but human beings, especially the law made by citizen. Marsilius argues that the essence of law is not the moral value but the coercion, and thus the use of judicial violence might be justified by virtue of the citizens’ consent. It is his contention that since the citizens' will is reflected in law through their discussion, the enforcement of the coercive law might be justified. This account not only is comparable to Rousseau's claim that the citizens become the master of law by means of their direct participation, but also suggests how to put the spirit of the law into practice through their discussion.
