Human rights and legal rights of the people involved area is expanded. in 2001 the National Human
Rights Commission of Korea as a public institution to deal with human rights was established, and the
responsibilities and obligations of the state and society to promote the human rights of the nation became
more important. The human rights-based perspective have a assumption that the role of social workers is
not to fill up needs of the client, but to promote rights respecting to individuality of the client.
The basic characteristics and the type of human rights are regulated in “Universal Declaration of
Human Rights”, “International Covenant on Civil and Political Rights”, “the Korean Constitution”, and
“National Human Rights Commission Act” etc. Also the roles and responsibilities of social services practice
for the promotion of human rights are regulated in “Social welfare Act”, and “the National Basic
Livelihood Security”. Social workers have to recognize human rights laws in order to understand the nature
and type of the client's human rights and have a professional responsibility to take consciously advantage
of rights-based perspective in practical activities. And they will be able to realize ethical practice in
internalizing human rights provisions in Social Worker Code of Ethics.
The interfering factors to promote human rights can occasionally occur in the social work field. But in
this situation, the social welfare practice on human rights-based perspective for social worker is the effective
strategy to ensure and promote the human rights of the client in planing and executing social service
delivery programs.
