국제 장애인권리협약(Convention on the Rights of Persons with Disabilities)은 2006년 12월 13일에 유엔 총회에서 채택되었고, 우리나라도 2007년 3월 30일에 협약에 서명하였다. 금년은 유엔장애인권리협약 이 채택된지 10주년이 되는 해로 그 의미가 깊다. 따라서 본 논문에서는 위 협약의 내용을 고찰하고 쟁점부분을 검토하고자 한다. 내용부분에서는 장애와 장애인의 정의, 위 협약을 장애인권리보장 모델 로 갈 것인지 차별금지 모델로 갈 것인지, 장애여성문제, 접근성과 개인의 이동문제, 장애인 차이에 대한 존중과 수용문제, 자립생활문제, 재활문제, 모니터링문제 등에서 관점차이가 있었다. 문제가 되 는 것에는, 먼저 환자의 자유로운 동의를 받지 않고 입원 치료가 가능한 정신보건법이 국제장애인권 리협약에 위반된다는 점이다. 특히 강제입원제도는 그 문제가 심각하다. 우리나라 정신보건법은 부 모, 배우자, 성인인 자녀 등 보호의무자가 동의하고 의사 한 사람이 진단하면 강제입원이 가능하도록 되어 있다. 따라서 독일이나 미국처럼 강제입원 자체를 법원이 결정하는 방향으로 개선되어야 하리 라고 본다. 그렇지 않으면 의사 1인이 진단하면 가능하도록 되어 있는 것을 의사 2인으로 하되 1인 은 다른 병원의사로 하는 것이 바람직할 것이라는 생각이다.
