지난 18대 국회에 들어 지방교육자치제도에 커다란 변화가 있었다. 본 논문의 연 구목적은 2010년 2월에 통과된 제20차 지방교육자치에 관한 법률이 개정된 배경과 법안의 성안과정에서 나타난 관련 이익집단 및 정부의 정치행태의 실제를 밝히는 데 있다. 연구문제는 첫째, 제20차 지방교육자치에 관한 법률의 개정배경은 무엇인가? 둘째, 동 법률의 개정을 둘러싸고 이해 당사자들간에 벌인 정치적 쟁점과 진행과정 은 어떠한가? 셋째, 최종 결정된 법률의 주요 내용은 무엇인가를 밝히고자 하였다. 연구내용은 제20차 개정법률안의 성안 과정에 나타난 정치행태들을 다양한 자료를 통해 밝히고자 하였다. 연구방법은 주로 문헌연구로 20차 개정법률의 역동성을 사실 적으로 밝히기 위해 국회의원들이 제출한 동법의 개정법률안과 국회회의록을 중심으 로 고찰하였다. 연구결과 최종 통과된 법률안은 교육과학기술위원회 법안심사소위원회의 여야합의 에 의한 대안과는 또 다른 제3의 안이 막후에서 협상되어 표결로 처리됨으로써 다양 한 이해 관계자들의 요구를 반영한 결과, 우여곡절 끝에 ‘깊고 누빈’ 법률로서 통과 되었음을 밝혔다.
The purpose of this study is to reveal the main contents of the 20th Local Education Autonomy Act and reality of political dynamics at the revision process of the Act which was passed in February 2010 in the 18th National Assembly. Study questions are like these. First, what is the revision background of the 20th Local Education Autonomy Act in the 18th National Assembly. Second, what are the political issues and how to progress the political process? Third, what are the main contents of the revision act. Study contents are to reveal the various political dynamics at the revision process of the 20th Local Education Autonomy Act through many materials. Research method is mainly bibliographical study, for example, revision acts that are made by national assemblymen and council's documents. Study findings are like these. Final act is the third act, that is completely different from mutual agreement legislation that was passed at the subcommittee of legislation investigation in the Committee of Education, Science and Technology. This study found that the act is the results of the compromise between government and various interesting groups. So the act is became another quilted act, and is worn to rags.
