오늘날 가정폭력은 세계적인 문제가 되었고, 중국의 가정폭력은 흔히 볼 수 있는 현상이며, 가정폭력 의 수단도 매우 잔인하고 다양화되어 있다. 가정폭력이 가져오는 많은 사회문제를 해결하기 위해 중국 은 2015년 말에 가정폭력방지법을 통과하였고, 본 법은 2016년 3월 1일부터 정식으로 실시하게 되었다. 본 연구에서는 가정폭력방지법의 제정배경, 현황 및 특성에 대해 연구하고, 본 법이 존재하고 있는 문 제점에 대한 분석을 통해 문제를 해결하기 위한 대책을 제시함으로써 중국의 가정폭력방지법을 개선할 뿐만 아니라 가정폭력 때문에 많은 피해를 받고 있는 가정폭력피해자에게 실행 가능한 법적인 지원을 제공하는 데 연구의 목적을 두고 있다. 이에 한국의 가정폭력방지법안과 비교하였고, 이를 토대로 중국 의 가정폭력방지법의 개선 방향을 제시하였다.
Domestic violence is increasingly becoming a global issue, the current domestic violence in our country is not uncommon,and domestic violence means cruel diversity. At the end of 2015, the anti domestic violence law was passed in China,and it was decided to be formally implemented in March 1, 2016. In this study the background, the current situation and the problems of the anti domestic violence law are studied. And this study also provides advices about practical legal aids to the victims of demestic violence. This is compared with the Domestic Violence Prevention Act of Korea. Based on this, I suggested the improvement direction of the domestic violence prevention law in China.
