본 연구는 장애인 차별금지 및 권리구제 등을 위한 지방자치단체의 장애인 인권조례를 비교 분 석을 목적으로 하며 분석결과를 통해 향후 장애인의 인권 증진을 위한 지방자치단체의 조례 제? 개정에 기초자료를 제공하고자 한다. 이를 위해 장애인 인권조례의 의미를 확인하고 관련 쟁점을 검토한 뒤, 이미 제·개정된 장애인 인권조례를 분석하였고 마지막으로 장애인에 대한 지역사회복지 가 보장되고 실현되기 위한 장애인 인권조례 개선방안에 대한 제언을 제시하였다. 2014년 7월 현재 224개의 지방자치단체 중 장애인 인권조례를 제정한 75개의 지방자치단체의 조례를 11개의 항목으 로 나누어 비교 분석하였다. 분석결과를 토대로 지방자치단체의 장애인 인권조례를 위한 제언은 다 음과 같다. 첫째, 전국 지방자치단체 장애인 인권조례 제정·개정이 확산되어야 한다. 둘째, 조례가 조속히 이행될 수 있도록 조례를 기반으로 설립·운영되는 행정조직을 구성해야 한다. 셋째, 이미 제·개정된 장애인 인권조례를 조속히 이행해야 한다. 넷째, 장애인 인권중심의 사회적 가치가 조성 될 수 있는 체계를 마련하는 노력이 중요하다.
The purpose of this study is to analyze the situation of disabled rights ordinance and to present the development plan for government officers in local community by analyzing establishment and revision movements of the ordinance. The disabled rights ordinance was enacted in the 75 municipalities of the 224 municipalities. The study compares 75 disabled rights ordinances into 11 items. Based on result of this study, the improvements of disabled rights ordinance are as follows: First, community should be expanded and revised. Second, administrative office based on disabled rights ordinance should be set up for conducting contents in ordinance effectively. Third, The local governments need to fulfill their duty of disabled rights ordinance. Fourth, it is important that we should try to provide a framework that can be built around social values of human rights of persons with disabilities.
