이 연구는 보육과 교육에 대한 요구가 높아지고 있는 시점에서 교육․보육내용과 관련된 법제 고찰을 통해 그 과제를 살펴보는데 목적을 두고 있다. 이를 위해 교육의 복지적 동기와 권리, 보육과정의 국가기준성, 보육과정에 대한 외적 여건의 정비에 대해 살펴보았다. 교육․보육은 투자적 동기보다는 복지적 동기의 성격이 우세하게 나타난다. 그리고 보육과정에서는 국가의 기준을 설정하는 것의 타당성과 그 관리 주체나 교육․보육과정의 고시 주체가 상이한 것은 교육․보육과정의 운영에서 문제를 낳을 소지가 있었다. 또한 교육․보육과정에 대한 외적인 조건의 정비에서는 인적인 자원, 물적인 여건의 정비, 그리고 학교 조직의 정비에 대해 살펴보았다. 이들의 논의 결과 보육과정의 국가기준 설정에서는 국가의 일정수준 유지와 보육의 자유를 어떻게 조화시킬 것인가의 과제가 있었다. 그리고 외적인 조건의 정비에서는 다차원화되어 있는 보육교사의 자격요건 정비, 보육시설에 대한 정비,국․공․사립에 대한 국가적 통제와 자원의 배분 등에 대한 과제가 있었다.
This paper is aim to explorer the task through analysis of legislation related to child care content. For the end, It discussed the rights and welfare motive on the education, national standards of child care content, and of organize of externa condition on child care content. Education and educare is superier welfare motive rather than investment motive in educational opportunities. In the process of child care, It review the feasibility of the setting of national criteria. The different management subject will cause problems in running it. And It look at the maintenance conditions; interna and externa condition. Democratic operation of the curriculum also find out about the organization. As a result, There is task on the maintain a certain level of education in establish of national standard, the organize of child care teachers qualifications, the align of infant caring facilities, control of nation by child care institute and proper distribution of resources.
