성년후견제도는 정신적인 장애 등으로 인하여 판단능력이 불충분한 사람의 재산관리와 신상보호에 관한 제도라 할 수 있지만, 동시에 시민사회 관계를 규율하는 민법상의 제도이 면서 더 나아가 사회복지제도 라는 측면이 있다. 성년후견제는 본래 사적인 법적 관계를 규율하는 민법상의 제도이지만, 복지의 영역과도 깊은 관련을 가지고 있어, 일정한 공적 개입과 사회복지계의 관심이 요구된다. 성년후견제는 장애인복지와 인권측면에서 오랫동안 열망해 온 법적 지원 제도로서, 2011년 2월 18일 국회 본 회의에서 금치산 및 한정치산 제 도 대신 성년후견제를 도입하는 민법 개정안이 통과되어서 2013년 7월에 시행을 앞두게 되었다. 이에 본 논문은 성년후견제도 도입의 의미와 성공적인 제도 정착을 위한 과제에 대해 사회복지적 관점에서 접근하였다. 성년후견인의 전문성과 관련하여, 성년후견인 양성 교육 및 보수교육을 담당할 수 있는 전담기관이 필요하다. 예를 들어, 사회복지사협회 및 사회복지교육협의회, 법무사협회, 기타법인 등을 지정하여 관련된 성년후견인 교육 실시 및 자격 부여가 필요할 것이다. 특히 장애와 노인영역 등 사회복지서비스 일선의 현장 전 문가로 알려진 사회복지사에 대한 성년후견제도 보수교육과 전문 양성교육이 요구된다. 본 연구 결과는 우리나라 성년후견제 도입 시행에 따른 의미와 향후 준비과제 적용을 위한 기초 자료로 이용될 것으로 기대한다.
The purpose of this study is to discuss the necessity and the plan of the guardian system with a focus on the social welfare. In Korea, incompetence system under the current civil law is rigid since it can provide two types. they are incompetent and quasi-incompetent. Among possible problems in the aged society, this paper will research the issues concerning social welfare, guardianship. Under such circumstances, this paper aims to review the guardianship system and problems to prevent and suggest some improvements. This study, first, reviewed the problems of current legal system in quasi-incompetence, incompetence, and guardianship system. Second, a guardianship system needs to coordinate legal protection in the property and affairs with social welfare services. Third, it pointed out an adult guardianship system in foreign countries and discussed the introduction and the solution of the system in Korea. In the respects, the guardianship law system in Korea is especially for the disabled and the senior it seems to be one of social welfare service.
