본 연구에서는 인지적으로 도전받는 장애인들의 인권침해를 ‘성폭력, 성적 삶의 향유 박탈, 생활시설에서의 인권침해’에 대해 살펴보고, 이런 장애인들의 인권을 옹호하고 보장하기 위한 방안을 제시하였다. 인지적 장애인들이 인지장애로 인해 자기 삶에서의 수많은 선택 과 결정의 기회를 박탈당해 왔는데 이것이 바로 인권침해이다. 모든 인간에게 조건 없이 보 편적으로 적용되는 원칙이자 천부적 권리인 인권이 인지적장애인들에게 잘 주어지지 않았 다. 사회복지사가 그들의 욕구를 사정하고 정의해주는 욕구중심의 사회복지 실천에서 벗어 나 인권중심의 실천을 하는 사회복지사는 인지적 장애인들과 함께 그들의 욕구를 사정하고 결정하며, 그들이 감당할 만한 위험을 겪게 하고, 어떤 결정에 의해 영향 받을 수 있는 모든 결정과정에 그들을 참여시켜 자기결정과 통제를 행사하도록 지원한다. 이것이 인지적 장애 인들의 인권을 존중하는 것이며, 인권중심의 사회복지실천을 수행하는 것이다.
Human rights is a theme that is receiving increasing attention in today's social welfare field. But the people with intellectual disabilities are still deprived of their own rights. In this perspective, this paper was studied on 3 categories in which they are violated. The 3 categories are sexual abuse, deprivation of sexual life, and violation of human rights in residential places. In addition, some ideas advocating and ensuring human rights of them were suggested in this paper. People with intellectual disabilities have been deprived of many opportunities which they can make in their own lives. Human rights is a principle and innate rights applied unconditionally and universally to all of the people in the world. But human rights has not been given to people with intellectual disabilities yet. Opposing to Social workers who have a needs-based perspective, social workers who have a rights-based perspective differently carry out their practices. The social workers armed with a right-based perspective help people with intellectual disabilities with assessing their own needs and allowing them to take dignity of risk. Besides, they let people with intellectual disabilities participate in all decision making processes affecting their own lives. The social workers who want to practice in human rights perspective are required to respect the rights of people with intellectual disabilities.
