비자발적 입원은 인권침해의 소지에도 불구하고 스스로 몸과 정신을 돌볼 수 없는 사람들의 건 강을 위해 필요하다는 온정주의와 그들이 가진 잠재적인 사회적 위협에 방어하기 위해 필요하다는 타자의 시각으로 정당화되어 왔다. 본 연구의 목적은 당사자의 시각에서 비자발적 입원 경험을 드 러내고자 하는 것이다. 정신장애인의 비자발적 입원을 하나의 현상으로 보고 이 현상을 총체적으로 이해하기 위해 비자발적 입원의 경험이 있는 12명의 정신장애인들과 심층면접을 통해 자료를 수집 하는 질적 사례연구방법을 활용하였다. 분석결과 비자발적 입원이 어떻게 시작하고 끝나는지에 관 한 정황, 비자발적 입원이 궁극적으로 연구참여자들에게 가져온 상흔과 변화, 그리고 비자발적 입 원의 대안에 관한 연구참여자들의 탐구로 구성되었다. 연구의 주요 함의는 첫째, 비자발적 입원으 로 들어서는 정신의료기관은 연구참여자들에게 폐쇄의 영속화를 부여함으로 공포의 대상이 되고 이러한 인식은 재차 입원에의 저항을 만들어 비자발적 입원의 악순환고리를 형성하고 있었다. 둘 째, 연구참여자들은 폐쇄병동의 폐쇄된 관계 속에서 작동하는 통제기제에 의하여 점차 자유의지와 통제력을 타자에게 이양하게 되었으며, 회복을 위해서는 양도한 자유의지와 통제력을 타자로부터 되찾아오는 힘겨운 과정을 겪어야 하였다. 셋째, 연구참여자들이 원하는 정신의료기관은 입원기간 이 짧고 인간적인 대접을 해주는 장소였으며, 폐쇄병동이 아닌 또다른 보호장치를 염원하였다.
A involuntary hospitalization by mandatory guardian based on the 24 Section of Mental Health Law is now confronted with criticisms. Some people consider it induces the violation of human rights due to make it possible to confine mentally disabled to hospital without the judgement of independent third party. A involuntary hospitalization has been justified in paternalistic thinking that it is necessary for people who cannot care their own body and mind and in a perspective of others that it is a required condition for safety to protect from latent social risk from them. This study explores the experience of involuntary hospitalization in a perspective of mentally disabled, We consider involuntary hospitalization of mentally disabled as a phenomenon, and try to understand this phenomenon wholly through qualitative case study. We interviewed in depths 12 mentally disabled who experienced involuntary hospitalization. The Results reveals the whole process of involuntary hospitalization, the ultimate scar and change of the hospitalized, and the exploration for the alternatives to prevent involuntary hospitalization. The findings underscore the importance of broadening our understanding of the whole effect of the involuntary hospitalization. It makes a vicious circle of involuntary rehospitalizaion due to the scar and change of the hospitalized. The hospitalized thought close ward does not cure mental disability but reproduces it. In this hole process, the hospitalized hand over their free will and a sense of control to the others, and they have to go through the regaining process for the recovery.
