이 연구의 목적은 국제사회 기준인 유엔아동권리협약(이하 CRC)에 기초하여 이주아동과 교육권의 객관적 개념을 정의하고, 이주아동의 교육권을 보장하기 위한 평가지표를 개발하는 것이다. 이를 위해 CRC 총 54개 조항 가운데 교육권을 규정한 제28조와 제29조의 내용을 분석했다. 개발된 지표에 근거하여, 한국의 현행 이주아동교육정책을 평가했다. 그 결과, 제안된 개선방안은 다음과 같다. 첫째, 목표가 모든 아동 최선의 이익과 교육권 보장으로 전환돼야 한다. 둘째, 대상이 미등록 이주아동에게도 확대돼야 한다. 셋째, 학교출석의 권장과 중도탈락을 방지하는 조치와 아동의 개별욕구에 맞춘 교육내용이 개발돼야 한다. 넷째, 전담인력의 CRC 교육이 강화되고, 행정조직 간 네트워크와 지지망이 확대돼야 한다. 다섯째, 근거법이 제정되고, 관련법의 실효성과 특별예산이 확보돼야 한다.
The purpose of this study is to define the objective concept of migrant children and the right to education and develop the evaluation indicators for securing their right to education in Korea, based on UN Convention on the Rights of the Child(CRC) which is the global standard. After content analysis of the article 28th and 29th of CRC which has 54 articles in total, this study developed the evaluation indicators and evaluated Korean polices for securing the right to education of migrant children from 2006 to 2010. The main suggestions are as follows. Firstly, purpose of the policy should be changed into securing the best interests and the right to education(education opportunity, education process, education result) of all the migrant children in Korea. Secondly, object of the policy should be expanded to the unregistered migrant children. Thirdly, contents of the education adjusting to individual child's needs should be developed and its effectiveness should be enforced. Fourthly, CRC education and training for the professional manpower should be enforced, and community network and support system among the related organizations. Fifthly, law for securing the best interests and the right to education of all the migrant children in Korea should be enforced and ample budget should be secured.
