본 연구는 의사결정능력이나 판단능력이 부족하여 독자적으로 법률행위를 할 수 없는 지적장애인, 정신장애인을 대상으로, 개인의 인권, 자기결정, 정상화, 잔존능력의 활용의 원칙 하에서, 현행 행위무 능력제도와 후견제도의 문제점을 분석하고, 새로이 도입될 성년후견제도에 대하여 검토하고자 한다. 지적장애인, 정신장애인이 우리 사회의 구성원으로서 후견인의 도움을 받아가며, 인간으로서의 존 엄과 가치를 보호받고, 자신의 남아있는 능력을 최대한 이용하여 자기결정을 함으로써, 자신의 삶을 주체적으로 형성해 갈 수 있도록 하기 위해서는, 법규범에 의해 국가 또는 사회가 공동으로 책임지고 보호해야 하는 사회제도, 사회복지제도의 환경이 조성되어야 할 것이다.
The study examined legal system, principles and problems of legislation of adult guardianship in Civil Law. The mentally retarded person and mentally disabled person have increased through development of modernization, industrialization, and urbanization. This analysed concept and problems of incapacitated adults and adult guardianship system in Civil Law, and then principles, contents and prospects of the new adult guardianship system in the proposed amendment of Civil Law. As a result of reviewing principles and contents and problems of legislation of adult guardianship in Civil Law, this study's suggestions are followings. First, the guardianship of existing Civil Law accompanies stigma. In addition, the matters concerning personal welfare of incapacitated adults are out of protection. So a new guardianship system and a lasting power of attorney system are necessary to protect wholly the incapacitated adults. Second, the mentally retarded person and mentally disabled person need a special guardianship system in order to live integrative life as a member of society under the principles of the respect, self-determination, normalization, and use of extant capacities. Finally, a new guardianship system needs to coordinate legal protection in the property and affairs with social welfare values and services.
